All purchases from www.agoons.com are subject to these terms & conditions and to the Danish Law of Purchase. During any purchase from www.agoons.com you will be asked to accept our terms & conditions. We encourage you to carefully read the terms & conditions, so you understand your obligations and rights. If you cannot accept the terms & conditions, your purchase cannot be completed.

We reserve the right to change these terms & conditions at any time. However, the terms & conditions at the time of order placing always apply to this order.

1 – Order Sequence

1.1 – Order Placing

Products are ordered online at www.agoons.com. You add the products to your shopping basket and then follow the onscreen instructions to input all relevant information (invoice and delivery address, manner of payment etc.) needed to complete the order. When the order has been completed, you will see a receipt on the screen. At the same time you will receive the receipt by e-mail. This receipt is processed automatically, and your order is not accepted until you have received an order confirmation by e-mail.

1.1.1 – Changes to Order/Cancellation of Order

If you wish to change or cancel an order, we ask you to contact us by e-mail (info@agoons.com) as soon as possible. Please refer to your order number.

1.2 – Dispatch of Order

When your order is ready for dispatch you will receive an e-mail from us. The invoice is attached to this e-mail. You will receive another e-mail from us when the order has left our warehouse. If the transport company offers a track & trace service (so you can follow the shipment’s way to you) it will appear on this e-mail.

1.3 – Receipt of Goods

When the product is delivered to you, you will be asked to sign for the delivery. Along with the products, you will receive a delivery note. You must check that the delivery note and the delivered products are consistent. Never sign a receipt of a product that does not conform to your order.

1.3.1 – Visible Damages

You must immediately check for visible damages (e.g. damaged packing). If you find any visible damages, you can either refuse delivery or make a qualified acceptance by clearly noting the damages along with your signature on the transport company’s consignment note. If you refuse reception we kindly ask you to inform us by e-mail (info@agoons.com) as soon as possible. If you choose to make a qualified acceptance you must immediately check the products for any damages and contact us by e-mail (info@agoons.com) – please refer to your order number. We encourage you to shoot digital photos as documentation of damages.

1.3.2 – Invisible Damages

See point 4 – Right to complain below.

We will contact you as soon as possible if any problems should occur during the process of your order.


2 – Delivery

We deliver to customers in most EU countries. Customers outside the EU can contact us by e-mail (info@agoons.com), and we will check the possibility of delivery. Guiding times of delivery can be found here. If any delays should occur, we will inform you as soon as possible. We deliver solely through reliable and reputable transport companies. Unless stated otherwise, you pay for the handling and transport costs. The amount depends on the total weight and place of delivery – see prices here. The total handling and shipping costs are always clearly stated before you complete the order.


3 – Right to Return

When you shop at www.agoons.com you are always entitled to our 100 days right to return policy – counted from the day you receive the products. You can make use of the right to return policy in the following two ways:

3.1 – Refuse Delivery

When we deliver the product, you can refuse to accept delivery.

3.2 – Return

If you have received your product, you can return it to us. You must return the product in the same quantity and condition as you received it. The right to return policy will therefore be void, if you use the product in a way that has clearly reduced the value of the product. We encourage you to return the product in its original packing. It is your responsibility that the product you return is packed properly. Before you return a product, you must notify us by e-mail (info@agoons.com). When you make use of the right to return policy, you must cover the return freight costs yourself. Products returned by cash on delivery will therefore be rejected. We can help you arrange the return transport – however, our normal freight prices do not apply to return transport.

Regardless of which way you choose to make use of your right to return, we will refund the amount as soon as we have checked the returned product. We endeavour to make your wait as short as possible.

4 – Right to Complain

We provide the right to complain within 24 months from purchase on all products according to the Danish Law of Purchase.

The right to complain means that you have the right to complain about defects that occur within the first 24 months after delivery of your product. It is a condition that the defect was present at the time you received the product. The right to complain becomes void, if the defect is caused by the buyer. You must complain within 2 months after the defect was discovered.

We can request documentation of any complaint – e.g. in form of digital pictures. You must describe the defect in as much detail as possible, so the complaint can be solved to the satisfaction of all parties as quickly as possible.

Normally, we solve complaints by sending spare parts free of charge. In these cases, we can request the defective parts be returned to us.

We endeavour to dispatch spare parts as quickly as possible, but since these are special orders, you must expect a little longer delivery time than normal.

We always assess if a complaint can be solved best by sending spare parts. If we assess that the complaint can be solved better another way, we will contact you. We reserve the right to cancel the transaction and refund the cost of good amount, in case alternative solutions will cause disproportionate costs.


5 – Products

Some products are delivered completely or partly unassembled. In these cases assembly instruction and fittings are included in the package.

Products may differ in details from pictures at www.agoons.com.

Products made of natural materials – e.g. wood – are never 100 % identical and may also change over time. This is not a valid reason for complaint.


6 – Prices

All prices at www.agoons.com are incl. 25 % Danish VAT, but excl. possible freight and handling fee. The total price incl. freight and handling fee appears clearly before you confirm your order. We charge no fees for payment by card.


7 – Terms of Payment

Orders are always prepaid. You can pay by card (Visa, Visa Electron, MasterCard, Maestro, JCB and American Express) during the order process or by bank transfer afterwards. We charge no payment fees. If you pay by card, the amount will not be charged to your account until the product has been dispatched from us. If you have chosen to pay by bank transfer, our bank information will appear on the receipt that is shown on the screen and sent to you by e-mail after completion of your order.


8 – Terms of Delivery

Normally, the customer pays the transport costs, but since this amount is prepaid along with the price of the goods, we state ”DDP” (Delivered Duty Paid) as the term of delivery. ”DDP” means that the transport is carried out at the risk and costs of the sender and that all taxes and duties are also paid by the sender.


9 – Conclusion of Agreement

Orders placed at www.agoons.com are binding. Therefore, you must make sure that all information is correct before you place your order.


10 – Languages

Our website is created in 3 languages; English, German and Danish, and our staff can assist you in these 3 languages.


11 – Data Policy

We do not register any other information than what you inform us yourself. The information will not be passed on to any unauthorised third party.


12 – Liability and Reservations

We refuse liability for delayed deliveries. We refuse liability for our products causing direct or indirect damage to other things or persons. We cannot be held responsible for customers’ legal issues with a third party.

We reject the responsibility for force majeure, typos, technical errors, delivery problems, sold out products, rise of prices and changes to VAT, taxes and duties.

All products remain property of Agoons ApS until full payment is received.


13 – Disputes

Any disputes must always be attempted to be solved between the two parties. If this is not possible, disputes must be settled according to Danish law at the district court in Viborg, alternatively Western High Court in Viborg.
